Certain House of Chaos products, platforms, services, programs, subscriptions, events, or other offerings may be subject to additional or separate terms.
Professional services provided by House of Chaos or one of its affiliated companies may also be governed by a separate proposal, statement of work, engagement letter, master services agreement, subscription agreement, license agreement, or other contract.
If there is a conflict between these Terms and a separate written agreement governing a specific service, product, or engagement, the separate agreement will control with respect to that service, product, or engagement.

Different liability provisions may apply to paid products or professional services under separate agreements.
To the extent permitted by law, you agree to indemnify and hold harmless House of Chaos and its affiliated companies, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:
This section does not require indemnification for conduct caused solely by House of Chaos where such indemnification would be prohibited by law.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE A DISPUTE HEARD IN COURT AND YOUR RIGHT TO A JURY TRIAL.
Before initiating arbitration or other formal legal proceedings, you and House of Chaos agree to make a good-faith effort to resolve the dispute informally.
A party seeking to raise a dispute must provide written notice describing:
Notices to House of Chaos should be sent to:
House of Chaos
3723 Greenville Ave, #13360
Dallas, TX 75206
contact@houseofchaos.productions
The parties will have 30 days after receipt of the notice to attempt in good faith to resolve the dispute before either party initiates arbitration, unless applicable law requires otherwise.
Any applicable statute of limitations will be tolled during this 30-day informal resolution period to the extent permitted by law.
Except for disputes expressly excluded below, you and House of Chaos agree that any dispute, claim, or controversy arising out of or relating to:
will be resolved through final and binding individual arbitration, rather than in court.
This arbitration agreement applies to claims involving House of Chaos as well as its current and former affiliates, subsidiaries, brands, officers, directors, employees, owners, contractors, agents, successors, and assigns, to the extent such claims arise from or relate to your use of the websites or these Terms.
The parties agree that this arbitration provision involves interstate commerce and that the Federal Arbitration Act ("FAA"), 9 U.S.C. §§ 1–16, will govern the interpretation and enforcement of this Section 18.
Except with respect to the arbitration procedure governed by the FAA and the applicable arbitration rules, the substantive law governing disputes will be determined in accordance with Section 19 below.
Arbitration will be administered by the American Arbitration Association ("AAA").
Unless a different set of AAA rules is required based on the nature of the dispute:
The applicable AAA rules are incorporated into this Section by reference.
The arbitration will be heard by a single neutral arbitrator.
For non-consumer disputes, unless the parties agree otherwise, the arbitration will take place in Dallas County, Texas, or remotely by videoconference where the arbitrator determines that remote proceedings are appropriate.
For qualifying consumer disputes, hearing location, filing fees, administrative costs, arbitrator compensation, and other procedural matters will be governed by applicable law and the applicable AAA Consumer Arbitration Rules.
If AAA is unavailable or unwilling to administer a dispute, the parties will attempt in good faith to select another nationally recognized arbitration provider. If they cannot agree, a court of competent jurisdiction may appoint an arbitration provider or arbitrator as permitted by the FAA.
The arbitrator may award any individualized remedy or relief that would otherwise be available in a court of competent jurisdiction, subject to these Terms and applicable law.
The arbitrator will issue a written decision sufficient to explain the essential findings and conclusions on which the award is based.
Judgment on an arbitration award may be entered in any court having jurisdiction.
Arbitration fees and costs will be allocated in accordance with the applicable AAA rules and applicable law.
Where consumer arbitration rules or applicable law require House of Chaos to pay particular arbitration costs or fees, House of Chaos will do so.
Nothing in these Terms is intended to require an individual consumer to pay arbitration fees that applicable law or applicable arbitration rules require the business to pay.
Notwithstanding the agreement to arbitrate above, either party may:
Nothing in this Section prevents either party from reporting conduct to or cooperating with a federal, state, or local governmental or regulatory agency.
If applicable law prohibits the arbitration or waiver of a particular claim or form of relief, that claim or request for relief will be handled as required by applicable law without invalidating the remainder of this Section to the fullest extent permitted.
TO THE EXTENT PERMITTED BY LAW, YOU AND HOUSE OF CHAOS EACH WAIVE THE RIGHT TO A TRIAL BY JURY FOR DISPUTES COVERED BY THIS ARBITRATION AGREEMENT.
Arbitration uses a neutral arbitrator instead of a judge or jury, and judicial review of an arbitration award is generally more limited than review of a court judgment.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND HOUSE OF CHAOS AGREE THAT CLAIMS COVERED BY THIS ARBITRATION PROVISION WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE PROCEEDING.
Unless House of Chaos and all affected parties agree otherwise in writing, the arbitrator may not consolidate the claims of more than one person or entity and may not preside over any class, collective, consolidated, coordinated, or representative proceeding.
If a final judicial determination finds that applicable law prevents enforcement of this waiver with respect to a particular claim or request for relief, that claim or request for relief will be severed and may proceed in a court of competent jurisdiction to the extent required by law, while any remaining arbitrable claims will remain subject to arbitration.
You may opt out of this arbitration agreement by providing House of Chaos with written notice within 30 days after the date you first become subject to these Terms.
Your opt-out notice must include:
The notice must be sent by email to contact@houseofchaos.productions with the subject line Arbitration Opt-Out, or mailed to:
House of Chaos
Attn: Arbitration Opt-Out
3723 Greenville Ave, #13360
Dallas, TX 75206
An opt-out applies only to the individual or entity submitting the notice and does not affect any other provision of these Terms.
Exercising your right to opt out of arbitration will not affect your ability to use our generally available websites or services.
If House of Chaos makes a material change to this Section 18 after you have become subject to these Terms, the revised arbitration provision will not apply to a dispute for which either party provided written notice before the effective date of the change, unless the parties agree otherwise.
This Section 18 survives termination of these Terms and your relationship with House of Chaos.
Except as otherwise provided by Section 18, these Terms and any dispute arising out of or relating to them will be governed by and interpreted under the laws of the State of Texas, without regard to conflict-of-law principles.
For any dispute or claim that is not subject to arbitration, the parties agree that any legal action will be brought in the applicable state or federal courts located in Dallas County, Texas, and each party consents to the jurisdiction and venue of those courts, except where applicable law requires otherwise.
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in effect.
Section 18.9 contains additional severability provisions specifically applicable to the Class Action and Representative Action Waiver.
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other rights.
These Terms, together with our Privacy Policy and any additional terms expressly applicable to a particular website feature, constitute the agreement between you and House of Chaos regarding your general use of our websites.
Separate written agreements governing professional services, technology products, subscriptions, licenses, or other commercial relationships remain separate and control where applicable.
